Mr. Kaplan’s practice focuses on all aspects of intellectual property, including patent prosecution, counseling clients on the acquisition, commercialization, and enforcement of patents, copyrights, trademarks and trade secrets, and the preparation and negotiation of technology-related agreements. His technical expertise includes software, hardware and business methods. 

 

Prior to joining PCT, Mr. Kaplan practiced law in the Washington, D.C. offices of K&L Gates and Dickstein Shapiro.  Mr. Kaplan also co-founded a technology-focused startup company and served as its CEO and General Counsel. 

 


Representative Matters
   
 
Represented a data warehousing and voter-modeling company in the preparation and negotiation of joint development agreements, licensing agreements, vendor agreements, data security and privacy agreements, non-disclosure agreements, and termination agreements.
 
Prepared and prosecuted patent applications for Fortune 500 companies, educational institutions, and startup ventures in the fields of e-commerce, telecommunications, wireless media content delivery, automotive telematics, data structures, Internet/Intranet design and maintenance, Internet multicasting, artificial intelligence systems, wireless piconet-based systems, circuits, financial instruments, investment vehicles, and business methods.
 
Counseled a national non-profit advocacy organization on contractual issues relating to joint ventures, co-branding agreements, trademark infringement, program policies and procedures, and vendor agreements.
 
Counseled an artificial intelligence software company regarding the development and execution of long-term intellectual property strategies.
 
Performed patent and trademark portfolio analysis for Fortune 500 companies in preparation for the licensing and purchase of patent portfolios, as well as mergers and acquisitions.
 
Performed open-source software exposure reviews for Fortune 100 companies in preparation for acquisitions.
 
Counseled a variety of technology companies on the validity and infringement of patents.
 
 Counseled clients regarding the patentability of innovations in a variety of technical areas.
 
Counseled software development consultants regarding contractual issues relating to information technology and website development agreements.
