PCT Law Group understands the procedural doctrines of particular import to class action litigation. Our attorneys have familiarity with class certification standards and procedures under Rule 23 of the Federal Rules of Civil Procedure and as revised by the Class Action Fairness Act (CAFA). We also have familiarity with the local rules of the area courts, which often proscribe certain requirements for commencing class actions and time limitations for filing certification motions.
Class actions provide the means whereby large numbers of claimants have their common claims adjudicated in a unitary proceeding. The justifications that led to the development of the class action include the protection of the defendant from inconsistent obligations, the protection of the interests of absentees, the provision of a convenient and economical means for disposing of similar lawsuits, and the facilitation of the spreading of litigation costs among numerous litigants with similar claims. United States Parole Comm’n v. Geraghty, 445 U.S. 388 (1980).
Given the large number of people involved in such a case, effective advocacy in class action cases require intelligent analysis of various procedural legal issues including standing, removal, joinder of parties, jurisdiction, and class certification.
